Abstract

This thesis aims to explore the influence of the gay rights movement on political secularism in relation to public policy in the Netherlands from 1911 to 1971. During this period, the gay rights movement utilized secular principles inherent to political secularism in order achieve the abolition of the discriminatory Article 248bis Sr. of the Dutch Penal Code. This anti-seducement law raised the age of consent for homosexual conduct to 21 years old, while the age of consent for heterosexual conduct was 16 years old. Consequently, this research analyzes the history of the gay rights movement with a specific focus on the secular principles that were promoted by the movement, most notably the secular principles of equality, tolerance and rational reason. Furthermore, Article 248bis Sr. related case studies of the prosecuted John Welbergen and L.A. Ries are analyzed to illustrate how secular principles were neglected by the state, citizens and certain professions. The findings reveal that the gay rights movement aided in strengthening the secular foundation of the Dutch state.
