Abstract
In this thesis, I examined the debate surrounding recent Quran burnings in the Netherlands and its relation to the Dutch legal system. These incidents have sparked discussions, particularly in Parliament, about the potential prohibition of desecrating holy books. The central research question is: "How do debates about banning Quran burnings in the Netherlands relate to the Dutch legal system?". Using critical discourse analysis, I focused on the social meaning behind the discourse I selected for analyzing the research question. The outcomes of this thesis show that various Dutch constitutional rights clash, creating a gray area. However, the research indicates that execution of legislation on religion creates an even greater challenge. These issues arise due to the special status of religion in legislation and the context-dependency of enforcing legislation on religion. The juridification of religion thus varies across different countries and regions.
